Warranty Information

1. Introduction

Thank you for choosing Agi-Drive.

Agi-Drive is committed to providing reliable products designed for the demanding conditions of the concrete transport industry and supporting our customers throughout the life of their Agi-Drive system.

This warranty outlines the terms and conditions of the voluntary Agi-Drive product warranty and explains the coverage provided to the original purchaser.

This warranty is provided in addition to any rights and remedies available under the Australian Consumer Law and other applicable laws.

If you have any questions regarding this warranty or require assistance, please contact Agi-Drive using the contact details provided in Section 10.

2. Duration of Warranty

2.1 Warranty Period

Agi-Drive provides a 12-month warranty against defects in materials and workmanship from the date of purchase.

The 12-month period relates to the Agi-Drive voluntary warranty only. Any rights available under the Australian Consumer Law may continue beyond this period where applicable.

2.2 Commencement of Warranty

The warranty period commences on the date of purchase shown on the customer’s proof of purchase.

2.3 Original Purchaser

This voluntary warranty is provided to the original purchaser and is non-transferable, except where otherwise required by law.

3. Warranty Coverage

3.1 Components Covered

Subject to the terms and exclusions in this warranty, Agi-Drive covers defects in materials and workmanship in Agi-Drive-supplied components including:

  1. HMI Display Unit

  2. Distribution Module

  3. Charging Cradle

  4. 12-Button Remote

  5. Agi-Drive Wiring Harnesses

  6. Other Agi-Drive manufactured or supplied control components where specifically included with the system

3.2 Normal Operation

This warranty applies where an Agi-Drive product develops a defect during normal use and has been installed, operated and maintained in accordance with Agi-Drive instructions.

3.3 Parts, Labour and Associated Costs

Under this voluntary warranty, Agi-Drive will repair or replace a defective Agi-Drive component where the claim is accepted.

Labour, diagnostic, removal, reinstallation, travel, call-out and other associated costs are not automatically included under this voluntary warranty.

Where reimbursement of labour or other associated costs is requested, Agi-Drive must be contacted before those costs are incurred and given a reasonable opportunity to diagnose the fault and determine the appropriate remedy.

Any reimbursement of third-party labour or associated costs requires prior approval from Agi-Drive where reasonably practicable and will be limited to reasonable costs and reasonable labour time for the work required.

Nothing in this section limits any rights or remedies available under the Australian Consumer Law.

3.4 Repair or Replacement

Where Agi-Drive determines that a defect is covered by this warranty, Agi-Drive may, subject to any rights the customer has under applicable law:

  • Repair the defective component

  • Supply a replacement component

  • Arrange another appropriate remedy

Where Agi-Drive supplies a replacement component, the customer must contact Agi-Drive before arranging third-party removal or installation work if reimbursement of those costs is intended to be claimed.

3.5 Agi-Drive Right to Assess the Fault

Agi-Drive must be given a reasonable opportunity to assess and diagnose a reported fault before third-party diagnostic work, repairs or replacement work intended to be claimed against Agi-Drive are carried out.

Agi-Drive may request:

  • Photographs or video

  • Diagnostic information

  • Electrical or system measurements

  • Remote troubleshooting

  • Inspection of the product

  • Return of the allegedly defective component

Costs incurred without first giving Agi-Drive a reasonable opportunity to diagnose or remedy the fault may not be reimbursed, except where reimbursement is required by law.

3.6 Approved Repairs

Warranty repairs must be authorised by Agi-Drive.

Repairs carried out by Agi-Drive or an Agi-Drive-approved technician using approved components will not affect warranty coverage.

3.7 Back-to-Base Warranty

Warranty repairs are generally provided on a back-to-base basis.

Where required, the product must be returned to Agi-Drive or another repair location nominated by Agi-Drive for assessment, repair or replacement.

3.8 On-Site Attendance

Where a customer requests on-site attendance by an Agi-Drive technician, travel, accommodation and call-out charges may apply unless:

  • Agi-Drive agrees otherwise; or

  • Agi-Drive is required by law to bear those costs.

Any applicable charges will be discussed with the customer before attendance where practicable.

4. Warranty Exclusions

The exclusions in this section apply to the Agi-Drive voluntary warranty. They do not exclude or limit any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.

4.1 General Exclusions

This voluntary warranty does not cover damage or faults caused by:

  • Normal wear and tear

  • Accident, misuse, abuse or neglect

  • Physical impact or external damage

  • Incorrect installation

  • Incorrect wiring or electrical connections

  • Incorrect power supply, voltage or polarity

  • Installation that does not comply with Agi-Drive instructions

  • Unauthorised repairs or modifications that cause or contribute to the fault

  • Use outside the product’s specified operating conditions

  • Water ingress resulting from damaged seals, damaged housings, incorrectly fitted plugs or disconnected electrical connectors

  • Incorrect cleaning practices

  • Corrosion, chemical attack or contamination caused by exposure outside the product’s intended operating conditions

  • Damage caused by concrete build-up, mechanical impact or external equipment

  • Continued operation after a fault has become apparent where continued use causes additional damage

4.2 Installation and Vehicle Integration

Agi-Drive systems may interface with truck, engine, CAN bus, hydraulic and mixer-body systems supplied by other manufacturers.

This voluntary warranty does not cover faults or damage caused by:

  • Incorrect vehicle integration

  • Incorrect CAN bus connection or configuration

  • Incorrect connection to vehicle electrical systems

  • Incorrect hydraulic installation or configuration

  • Incompatible truck, engine, mixer-body or third-party interfaces

  • Incorrect installation or configuration by the installer

  • Vehicle or mixer-body systems operating outside the requirements specified by Agi-Drive

  • Changes made by a vehicle, mixer or other equipment manufacturer that affect compatibility with the Agi-Drive system

Where an Agi-Drive component itself is defective, the presence of a third-party vehicle or mixer system does not automatically exclude warranty coverage.

4.3 Remote Control

The Agi-Drive remote is designed for use with its protective silicone sleeve fitted.

Damage caused by dropping, impact, crushing, misuse or operation without the protective sleeve where removal of the sleeve has contributed to the damage is not covered by this voluntary warranty.

Removal of the silicone sleeve alone does not automatically void the warranty for an unrelated defect.

4.4 Distribution Module and Electrical Connectors

The Agi-Drive Distribution Module is designed for external installation and carries its specified environmental protection rating when correctly installed with all seals and connectors properly fitted.

High-pressure washing of the correctly installed Distribution Module does not by itself void the warranty where the product is used within its published specifications.

However, this voluntary warranty does not cover water ingress or damage caused by:

  • High-pressure washing of disconnected or open electrical connectors

  • Missing, damaged or incorrectly fitted seals

  • Damaged connector housings

  • Incorrect installation

  • Modification of the enclosure, connectors or seals

4.5 External Accessories and Third-Party Components

Agi-Drive is not responsible under this voluntary warranty for defects in accessories, components or equipment that were not manufactured or supplied by Agi-Drive.

Damage to an Agi-Drive product caused by incompatible, incorrectly installed or unauthorised third-party products may not be covered by this voluntary warranty.

The use of a third-party product does not automatically void the warranty where that product did not cause or contribute to the Agi-Drive fault.

4.6 Unauthorised Modifications

Unauthorised modifications do not automatically void the entire Agi-Drive warranty.

However, damage or faults caused or contributed to by an unauthorised modification, alteration, software change, wiring change or repair may not be covered under this voluntary warranty.

Agi-Drive will assess whether the modification contributed to the reported fault when determining warranty coverage.

5. Obtaining Warranty Service

5.1 Contact Agi-Drive First

Customers must contact Agi-Drive as soon as reasonably practicable after becoming aware of a fault.

Where reimbursement of diagnostic, labour, repair, removal, installation, travel or other costs is intended to be claimed, Agi-Drive must be given a reasonable opportunity to assess the fault and provide a remedy before those costs are incurred, except where circumstances make this unreasonable or where the customer has other rights under applicable law.

5.2 Initial Troubleshooting

Before a product is returned or replaced, Agi-Drive may request that reasonable troubleshooting or diagnostic checks be carried out.

This may include:

  • Checking wiring and electrical connections

  • Checking system settings

  • Checking vehicle or mixer inputs

  • Providing photographs or videos

  • Providing diagnostic information

  • Installing Agi-Drive-approved software where appropriate

  • Carrying out other reasonable checks requested by Agi-Drive Technical Support

5.3 Third-Party Diagnostic and Labour Costs

Agi-Drive does not automatically accept responsibility for third-party diagnostic or labour costs.

Where third-party work is required and reimbursement is sought, Agi-Drive should be contacted beforehand and given the opportunity to:

  • Diagnose the fault

  • Confirm what work is required

  • Provide technical instructions

  • Supply a replacement component

  • Approve reasonable labour time and costs

Where Agi-Drive could reasonably have diagnosed or rectified the fault more efficiently, excessive or unnecessary third-party diagnostic or labour costs may not be reimbursed, subject to any rights available under the Australian Consumer Law.

5.4 Information Required

When making a warranty claim, the customer may be asked to provide:

  • Name and contact details

  • Company name

  • Proof of purchase

  • Product serial number

  • Truck make, model and year where applicable

  • Mixer make or model where applicable

  • Description of the fault

  • Photographs, videos or other diagnostic information reasonably required to assess the claim

5.5 Return Authorisation

Where Agi-Drive requires a product to be returned, return instructions will be provided by Agi-Drive Technical Support.

Products should not be returned without first contacting Agi-Drive.

5.6 Return of Failed Components

Agi-Drive may require an allegedly defective component to be returned for inspection before finalising a warranty claim or approving reimbursement of third-party costs.

Where Agi-Drive supplies a replacement component before receiving the failed component, the customer must retain the failed component and return it if requested.

5.7 Packaging

The customer must take reasonable care when packaging products for return.

Damage caused during transport due to inadequate packaging may not be covered by the voluntary warranty.

5.8 Freight and Other Claim Expenses

Responsibility for freight and other expenses associated with a warranty claim will depend on the circumstances of the claim and the customer’s rights under applicable law.

Agi-Drive will advise the customer of the proposed freight arrangements when the claim is assessed.

Nothing in this warranty requires a customer to bear an expense that Agi-Drive is required by law to pay or reimburse.

5.9 No Fault Found

If a returned product is tested and no defect covered by this voluntary warranty is identified, Agi-Drive may contact the customer to discuss further testing, return freight or other reasonable charges before those charges are incurred.

This does not affect any rights or remedies available under applicable law.

6. Customer Responsibility to Minimise Loss

6.1 Prompt Notification

Customers should notify Agi-Drive promptly after becoming aware of a fault.

6.2 Minimising Further Loss

Customers are expected to take reasonable steps to minimise further damage, downtime and associated costs after a fault is identified.

This includes, where reasonable:

  • Contacting Agi-Drive promptly

  • Following Agi-Drive diagnostic instructions

  • Allowing Agi-Drive a reasonable opportunity to provide a remedy

  • Avoiding unnecessary third-party diagnostic work

  • Avoiding continued operation where doing so may cause further damage

6.3 Unauthorised Costs

Agi-Drive does not automatically accept liability for costs incurred before Agi-Drive has been notified of the fault or given a reasonable opportunity to assess and remedy it.

This includes:

  • Third-party diagnostic costs

  • Electrician or technician labour

  • Removal and installation costs

  • Travel and call-out costs

  • Replacement components purchased from third parties

Any such claim will be assessed individually, including whether the cost was necessary, reasonable, caused by the Agi-Drive fault and recoverable under applicable law.

7. Vehicle Downtime, Lost Income and Consequential Loss

7.1 Voluntary Warranty

The Agi-Drive voluntary warranty does not automatically include compensation for:

  • Vehicle downtime

  • Loss of use

  • Lost loads

  • Lost contracts

  • Loss of income or revenue

  • Loss of production

  • Third-party penalties or charges

  • Hire vehicles or replacement equipment

  • Other consequential or indirect costs

7.2 Assessment of Claims

Where compensation is claimed for loss or damage associated with an Agi-Drive product failure, the claim will be assessed having regard to:

  • Whether the loss was caused by the Agi-Drive product failure

  • Whether the loss was reasonably foreseeable

  • Whether the amount claimed can be reasonably substantiated

  • Whether reasonable steps were taken to minimise the loss

  • Whether Agi-Drive was notified promptly

  • Whether Agi-Drive was given a reasonable opportunity to diagnose and remedy the fault

Nothing in this section excludes or restricts any entitlement to compensation that cannot lawfully be excluded under the Australian Consumer Law.

7.3 Evidence of Loss

Where compensation for downtime, lost income or other loss is claimed, Agi-Drive may request reasonable supporting information such as:

  • Invoices

  • Work records

  • Delivery records

  • Repair records

  • Technician reports

  • Evidence of actual lost work

  • Other information reasonably required to assess the claim

8. Product Modifications

8.1 Agi-Drive-Authorised Modifications

Modifications or updates authorised by Agi-Drive will not, by themselves, void the warranty.

8.2 Software

Only software supplied or approved by Agi-Drive should be installed on Agi-Drive equipment.

Damage or malfunction caused by unauthorised software, modified software or incorrect software installation may not be covered by this voluntary warranty.

8.3 Assessment of Modifications

Where a product has been modified, Agi-Drive will assess whether the modification caused or contributed to the reported fault before determining warranty coverage.

9. Customer Responsibilities

9.1 Correct Operation

Customers are responsible for operating and maintaining the Agi-Drive system in accordance with Agi-Drive operating instructions and safety requirements.

9.2 Pre-Start Safety Checks

Customers are responsible for carrying out appropriate pre-start checks before operating the vehicle or mixer.

Rear Emergency Stop buttons should be tested as part of the daily pre-start inspection to confirm correct operation.

9.3 Faults and Damage

Where a fault may affect safe operation, the equipment should not continue to be used until the issue has been assessed.

Customers should take reasonable steps to prevent further damage after a fault has been identified.

11. Australian Consumer Law

The benefits provided by this Agi-Drive warranty are in addition to other rights and remedies available under the Australian Consumer Law.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing contained in this warranty is intended to exclude, restrict or modify any right or remedy that cannot lawfully be excluded, restricted or modified.
